Terms and Conditions (T&Cs)

Welcome to Flofrei®! On this website, the terms "we", "us" and "our" refer to Flofrei®. Flofrei® operates this online store and website, including all information, content, features, tools, products and services, to give you as a customer a tailored shopping experience (the "Services"). Flofrei® is powered by Shopify, which enables us to provide the Services technically.
The following Terms and Conditions, together with the policies referred to in them (these "T&Cs"), describe your rights and obligations when using our Services.
Please read these T&Cs carefully, as they contain important information about your legal rights and cover topics such as disclaimers of warranty and limitations of liability.
By visiting, interacting with or using our Services, you agree to these T&Cs and our Privacy Policy [LINK]. If you do not agree to these T&Cs or the Privacy Policy, you may not use our Services.
§ 1 – ACCESS AND ACCOUNT
By agreeing to these T&Cs, you confirm that you are at least of legal age and that you give us your consent to allow minor members of your household to use the Services on devices that you own or manage.
To use the Services, including accessing our online store or buying products, you may be asked to provide certain information, such as your email address and billing, payment and delivery details. You confirm that all information you provide is correct, current and complete and that you are entitled to provide this information.

We do not guarantee that the appearance or quality of the products you buy will meet your expectations or match how they are shown in our online store.
All product descriptions may be changed at any time without notice at our discretion. We reserve the right to discontinue products at any time and to limit order quantities per person, region or jurisdiction.
§ 3 – ORDERS
By placing an order, you make an offer to buy. Flofrei® reserves the right to accept or decline your order at its own discretion. Your order is only deemed accepted once it has been confirmed by Flofrei®. Receipt and processing of your payment are a condition for the acceptance of your order. Please check your order carefully before submitting it, as it may no longer be possible to cancel it once it has been accepted. If we do not accept, change or cancel an order, we will try to notify you by email, at the billing address or at the phone number provided with the order.
Returns or exchanges of your purchases are handled exclusively in accordance with our Refund Policy [LINK].
You confirm that your purchases are intended for personal or household use and not for commercial resale.
§ 4 – PRICES AND BILLING
Prices, discounts and special offers may change at any time without notice. The price charged for a product is the price valid at the time of the order and is stated in the order confirmation email. Unless expressly stated otherwise, prices do not include shipping costs or customs duties. Statutory VAT, where applicable, is included in the prices shown.
Prices in our online store may differ from prices in physical stores or at third-party sellers. We may occasionally run promotions that are subject to their own terms. In the event of a conflict between the promotion terms and these T&Cs, the promotion terms take precedence.
You agree to provide current, complete and correct purchase, payment and account information for all purchases in our store and to update it promptly if it changes.
You confirm that (i) the payment information you provide is correct and complete, (ii) you are authorised to use the payment method provided, (iii) the amounts due will be paid by your payment provider and (iv) you will pay the prices charged, including shipping costs and all applicable taxes.
§ 5 – SHIPPING AND DELIVERY
We are not liable for delays in shipping and delivery. All delivery times are estimates only and do not constitute a guarantee. We are not responsible for delays caused by shipping carriers or circumstances beyond our control. Once the products have been handed over to the shipping carrier, ownership and risk of loss pass to you, to the extent permitted by law. For consumers, the risk of loss remains with us until handover to you, in accordance with the statutory provisions.
§ 6 – INTELLECTUAL PROPERTY
Our Services, including all trademarks, texts, illustrations, images, graphics, product reviews, video and audio files and their design, selection and arrangement, are the property of Flofrei®, its affiliated companies or licensors and are protected by German, European and international copyright and trademark law.
These T&Cs allow you to use the Services exclusively for personal, non-commercial purposes. Without our prior written consent, you may not reproduce, distribute, modify, publicly display, download, store or transmit the content of the Services. Unauthorised use of the Services may violate applicable law.
§ 7 – THIRD-PARTY TOOLS
We may give you access to third-party tools that we neither monitor nor control. You agree that we provide access to such tools "as is" and "as available" without any warranty.
§ 8 – THIRD-PARTY LINKS
The Services may contain content and links to third-party websites. We are not responsible for examining or evaluating the content or accuracy of third-party materials. Complaints or questions about third-party products must be directed to the respective third party.
§ 9 – RELATIONSHIP WITH SHOPIFY
Flofrei® is powered by Shopify. However, all sales and purchases in our store are concluded directly with Flofrei®. By using the Services, you agree that Shopify is not responsible for any aspect of the transactions between you and Flofrei®. You hereby expressly release Shopify and its affiliated companies from any liability in connection with your purchases from Flofrei®.
§ 10 – PRIVACY
All personal data collected through the Services is subject to our Privacy Policy [LINK]. By using the Services, you confirm that you have taken note of this privacy information.
§ 11 – FEEDBACK
If you send us ideas or feedback, you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce and display this feedback for any purpose, including commercial use.
§ 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, our Services may contain information with typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions and availability. We reserve the right to correct errors and update information at any time or to cancel orders without prior notice.

UNLESS EXPRESSLY STATED OTHERWISE BY FLOFREI®, THE SERVICES AND ALL PRODUCTS OFFERED ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED. YOUR STATUTORY WARRANTY RIGHTS REMAIN UNAFFECTED.
§ 16 – LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, FLOFREI® AND SHOPIFY ARE NOT LIABLE FOR ANY INJURIES, LOSSES, CLAIMS OR DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR OF PRODUCTS PURCHASED THROUGH THE SERVICES. MANDATORY STATUTORY LIABILITY CLAIMS, IN PARTICULAR UNDER THE PRODUCT LIABILITY ACT AND IN THE EVENT OF INJURY TO LIFE, BODY OR HEALTH, REMAIN UNAFFECTED.
§ 17 – INDEMNIFICATION
You agree to indemnify Flofrei® and Shopify against any claims or demands by third parties, including reasonable legal fees, arising from or as a result of your breach of these T&Cs.
§ 18 – SEVERABILITY
If any provision of these T&Cs is declared invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a valid provision that comes closest to the economic purpose of the original provision.
§ 19 – ENTIRE AGREEMENT
These T&Cs and all policies published by us on this website constitute the entire agreement between you and us and govern your use of the Services.
§ 20 – ASSIGNMENT
You may not assign your rights or obligations under these T&Cs without our prior written consent. We may assign our rights and obligations without your consent.
§ 21 – GOVERNING LAW
These T&Cs and any separate agreements under which we provide Services to you are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with merchants, legal entities under public law or special funds under public law is [place of jurisdiction].
